By commissioning me for custom artwork, you are agreeing to the terms of service outlined below:➺ GENERAL DISCLAIMERS
✦ I reserve the right to refuse or discontinue a commission at any time.
✦ Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. The commissioner will receive full or partial refund depending on amount of work completed. I will have full right to refuse any service to the commissioner in the future.
✦ The terms outlined here may vary slightly depending on the type of commission.➺ COMMISSIONER OBLIGATIONS
✦ Provide multiple clear reference images of the character/subject.
✦ Mood boards are welcome!
✦ Maintain professional conduct throughout the commission process.
✦ Respond in a timely fashion.
✦ Assume responsibility for any important information and clear descriptions/references you fail to provide me that results in my inability to complete your commission to your full satisfaction.
✦ Carefully read through the ToS and Commission Information.➺ PAYMENTS
✦ Payment is done through PayPal invoice using USD.
✦ Half of the invoice will be paid up front The other half has to be paid on approval of the initial sketch.
✦ Work on the commission will not commence until payment has been received according to the above schedule.
✦ A rush fee will be charged for tight deadlines.
✦ A design fee will be charged for clients with no reference images that would like me to draw solely from a description and/or a collection of photos.➺ FINAL PRODUCT DELIVERY
✦ The final illustration will be delivered digitally to the email address provided by the commissioner, after the final payment has been received.
✦ Any other method of delivery, either digital or physical, has to be mutually agreed before the work commences. The commissioner is obliged to bear any costs incurred by alternative delivery methods, such as postal costs, material costs, digital service subscription fees etc.
✦ It is the sole responsibility of the commissioner to propose a delivery method which works for both parties.I cannot be held accountable for the commissioner’s loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside of my control or responsibilities.
✦ Upon delivery of the product, it is the commissioner’s responsibility to store it properly. Loss of the file/work due to negligence will not be reimbursed. I can not guarantee that the original copy of the product will be available in the case that the commissioner lost their files.➺ PROCESS & WORK SCHEDULE
✦ Resolution of the art will be agreed upon at the beginning of the commission. I have the right to negotiate a smaller size if my device is unable to accommodate something larger.
✦ I will send over a sketch for approval before continuing the commission. I will accept revisions as per the ‘REVISIONS’ point.
✦ I will show WIPs via email throughout the commission process.
✦ Sketch and subsequent in-progress shots will initially be sent as low-res, watermarked images.
✦ Deadlines must be agreed upon prior to the start of the commission.
✦ I will always do my best to complete your commission within a timely manner, but please understand that sometimes life may get in the way and cause a delay in completing your commission. I will notify you as soon as possible of any issues that come up to keep you informed.
✦ The commissioner agrees to contact me in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication on behalf of the commissioner will be recognized as implicit approval of all work progress and current state of the artwork.➺ REVISIONS
✦ The commissioner has the right to 3 complete revisions and a reasonable amount of minor revisions in the sketching phase.
✦ A limited amount of minor revisions are allowed in the colouring/painting stage and are covered in the commission price.
✦ Excessive minor revisions to the point that forward progress on the work has halted will incur additional fees.
✦ Revisions due to my own negligence are free.
✦ Additional major revisions will incur additional fees.➺ CURRENCY CONVERSIONS
✦ The commissioner agrees to pay the total amount specified in United States Dollar (usd)
✦ It is the sole responsibility of the commissioner to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds.➺ COPYRIGHT & USAGE POLICY
✦ I, the artist, retain the rights over any commissioned works.
✦ I reserve the right to post the commissioned work on my social media.
✦ I reserve the right to stream, record, and upload videos of the creation of the artwork.
✦ Any characters portrayed in the commissioned work remain copyrighted to their rightful owners.
✦ The final product is strictly for your personal use only, unless you purchase commercial rights.
✦ You must credit and link back to me/tag me when sharing or using the commissioned work.
✦ For commercial use, you must purchase the rights from me at 300% the original price.
✦ Credit is still required when using the work in any form commercially.
✦ You may use or edit the commissioned work in the following ways:
i) Print the work for personal use.
ii) Crop and/or resize the image for use as an avatar, header, video thumbnail, etc.
iii) Use the artwork as reference for a study.
iv) Post the artwork on social media, with credit to me clearly visible.
✦ You may NOT use or edit the commissioned work in the following ways:
i) Claim the artwork as yours.
ii) Remove my watermark/signature.
iii) Paint over or otherwise alter the artwork in ways not covered under the allowed uses above.
iv) Colour in my sketches or lineart.
v) Use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
vi) Use the product for AI datasets or for AI tools and any present or future inventions in the space.
vii) Reproduce the work commercially without purchasing the rights from me.➺ REFUND AND CANCELLATION POLICY
✦ The commissioner has the right to request a full refund if there's been no progress for two consecutive months, or when Product has not been completed within four months without any proper contact and/or reasons from me.
✦ Once the final product is approved, a refund is not permitted.
✦ The commissioner may cancel the commission any time, after which I will issue a refund equivalent to the amount of work not done.
✦ I reserve every right to refuse or cancel any order, under condition of full refund, without giving reasons to the commissioner..
✦ The commissioner may not file a chargeback against me after you have given approval of the artwork.
✦ Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. The commissioner will receive a full or partial refund depending on the amount of work completed. I will have full right to refuse any service to the commissioner in the future.
